1.     Definitions :

• · “Fine Jewelry” refers to any jewelry made of precious metals such as gold, silver, platinum, or palladium, with or without, set precious stones such as diamonds, rubies, emeralds, or sapphires.
• · “Repair” refers to any service provided to fix a defect or damage to the fine jewelry.
• · “Warranty” refers to any promise made by Eligius Fine Jewelry regarding the quality of its Fine Jewelry Products.

2.     Repair Services:

• · The repair services provided will be performed by skilled and experienced jewelers.
• · Repair services will be completed in a timely and efficient manner.
• · The customer will be provided with an estimate of the repair cost before the service is performed.
• · Any additional repairs needed beyond the original estimate will require customer approval before being performed.
• · The repair service may come with a warranty, as detailed in section 4.

3.     Warranty Services:

• · The repaired Fine Jewelry is warranted for thirty (30) days against any defects in materials and workmanship.
• · The warranty covers any defects due to the repair or damage resulting from normal wear and tear within 30 days, but not of customer misuse.
• · The warranty does not cover loss, theft, or damage due to mishandling or accidents.
• · In the event of a warranty claim, the customer must provide proof of purchase or “repair order” and the original piece of jewelry.
• · The warranty entitles the customer to repair services as detailed in section 2.

4.     Limitations of Liability:

• · Eligius Fine Jewelry shall not be liable for any incidental or consequential damages arising out of the use or inability to use the fine jewelry.
• · Eligius Fine Jewelry’s liability under this agreement shall be limited to the purchase price amount of fine jewelry.
• · Eligius Fine Jewelry shall not be liable for any damages resulting from the repair of fine jewelry by another entity.

5.     Miscellaneous:

• · These terms and conditions shall be governed by and construed in accordance with the laws and jurisdiction of New York.
• · Any disputes arising out of or related to these terms and conditions shall be resolved amicably whenever possible; or if need be, by arbitration.
• · These terms and conditions constitute the entire agreement between the parties and supersede all prior agreements and understandings, whether written or oral.
• · These terms and conditions may only be amended in writing
